Terms of Service
1. Acceptance of Terms
By accessing or using Lapidary ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. The Service is operated by an individual based in Finland.
2. Description of Service
Lapidary is a personal collection management application that allows users to organise, catalogue, and document their gemstone collections. The Service is provided free of charge.
3. User Accounts
To use the Service, you must create an account using a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use of your account
You must be at least 13 years of age to create an account.
4. User Content
You retain ownership of all content you submit to the Service, including photographs, descriptions, and notes ("User Content"). By submitting User Content, you grant Lapidary a limited, non-exclusive licence to store and display that content solely for the purpose of providing the Service to you.
You are solely responsible for your User Content and represent that you have all necessary rights to submit it.
5. Administrative Access to User Data
Important notice regarding data access: The Service does not implement end-to-end encryption. As a result, the operator of the Service has technical administrative access to all data stored on the platform, including User Content, photographs, collection entries, notes, and account information. This access exists by virtue of the operator's administrative role over the underlying infrastructure.
The operator undertakes not to access, review, copy, share, sell, or otherwise use any individual user's data except where required by applicable law or to investigate a specific, credible security incident directly affecting the Service.
By using the Service, you acknowledge and accept that your data is stored without end-to-end encryption and that this technical access exists.
6. Data Isolation Between Users
The Service implements row-level security controls to ensure that each user's data is isolated from other users. No user can access, view, or modify another user's data through normal use of the Service. Data isolation is enforced at the database level.
7. Acceptable Use
You agree not to use the Service to:
- Upload content that is illegal, harmful, or infringes the rights of others
- Attempt to gain unauthorised access to the Service or its infrastructure
- Interfere with the operation of the Service
- Use the Service for any commercial purpose without prior written consent
8. Service Availability
The Service is provided on an "as is" and "as available" basis. The operator makes no guarantees regarding uptime, availability, or continuity of the Service. The Service may be modified, suspended, or discontinued at any time without notice.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the operator of Lapidary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising from your use of or inability to use the Service.
The operator's total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you have paid to use the Service in the twelve months preceding the claim. As the Service is currently free, this amount is zero.
10. Termination
You may delete your account at any time. Upon deletion, your data will be removed from the Service in accordance with the Privacy Policy. The operator reserves the right to terminate or suspend accounts that violate these Terms.
11. Changes to Terms
These Terms may be updated from time to time. Continued use of the Service following any changes constitutes acceptance of the updated Terms. The "last updated" date at the top of this page will reflect any changes.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Finland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Finland.
